This Privacy Notice explains how Happy Heaven handles personal information when you use Happy Heaven Family Link.
1. Information We May Collect
Depending on how Family Link is used, we may process information including:
Account information: your name, contact information, account details and relationship to the child.
Child information: the child’s name, relevant identifying information and information necessary for managing child arrangements.
Communication information: messages, updates, arrangements, dates, times and information shared through Family Link.
Technical information: login information, security records, IP/device information and other technical data necessary to operate and secure the platform.
Case information: where relevant, information concerning contact arrangements, referrals or court-directed arrangements.
Some information communicated through Family Link could constitute special category personal data, for example information concerning health, ethnicity or other particularly sensitive matters. Appropriate additional protections and a valid legal condition must apply where such information is processed.
2. Why We Use Personal Information
We may process information to:
* Create and administer Family Link accounts;
* Verify authorised users;
* Facilitate communication about children;
* Maintain an accurate communication history;
* Administer child contact and handover arrangements;
* Provide technical and customer support;
* Protect the security and integrity of Family Link;
* Respond to safeguarding concerns;
* Investigate complaints or misuse;
* Establish, exercise or defend legal claims where appropriate; and
* Meet applicable legal and regulatory requirements.
UK data-protection law requires organisations to identify an appropriate lawful basis before processing personal information and to tell individuals about the basis and purpose.
Before publishing this section, Happy Heaven should insert its confirmed Article 6 lawful basis/bases and, where applicable, Article 9 conditions following its data-protection assessment.
3. Who Can See Your Information
Information may be accessible, as appropriate, to the other authorised Family Link user(s) connected to the family account and authorised Happy Heaven personnel who require access for legitimate operational, safeguarding, technical or legal purposes.
We may also share relevant information with courts, CAFCASS, local authorities, police, safeguarding agencies, professional advisers, IT/service providers or other organisations where we have an appropriate lawful basis or are legally required to do so.
We do not sell your personal information.
4. Children’s Information
Although Family Link is intended to be used by parents and authorised adults, the service necessarily processes information relating to children.
Happy Heaven will seek to minimise the amount of children’s information collected and use it only where reasonably necessary for the relevant purposes.
If children themselves will be permitted to create accounts or directly access Family Link, Happy Heaven should carry out a separate assessment before enabling that functionality. The ICO’s Children’s Code can apply to online services likely to be accessed by under-18s, even where children are not the intended audience.
5. How Long We Keep Information
Personal information will only be retained for as long as reasonably necessary for the purposes for which it was collected and in accordance with Happy Heaven’s applicable retention policy.
Some records may need to be retained after an account is closed because of safeguarding, legal, regulatory, complaint-handling or record-keeping requirements.
Account closure therefore does not automatically result in immediate deletion of all Family Link records.
6. Security
Happy Heaven takes reasonable organisational and technical measures to protect personal information against unauthorised access, loss, alteration or disclosure.
Users also have a responsibility to protect their login credentials and devices.
7. Your Data Protection Rights
Depending upon the circumstances and the lawful basis being relied upon, you may have rights concerning your personal information, including rights to request access, correction, erasure or restriction and to object to certain processing.
Some rights are subject to legal exemptions, particularly where records need to be retained for safeguarding, legal proceedings or other lawful purposes.
8. Consent and Withdrawal
Where Happy Heaven relies specifically upon your consent for an optional processing activity, you may withdraw that consent.
Withdrawal will not affect processing already lawfully carried out before withdrawal and will not necessarily require deletion of information that Happy Heaven is entitled or required to retain under another lawful basis.
The ICO recommends that consent requests be clear, separate from general terms, based on a positive opt-in and not use pre-ticked boxes.
